Texas Notarial Acts

A notary in the state of Texas can only notarize in the State of Texas and only when the person signing the document personally appears. Documents must be signed in the notary’s presence and cannot be backdated.

The primary responsibility of your notary is to prevent fraud by making sure you are properly identified and that you are aware of and agree to what you are signing.

If your document does not contain a notarial certificate, your notary will give you certificates to choose from. A notary cannot choose one for you, because that would be practicing law.

When you have picked out a certificate, the notarization will be done after you have identified yourself with a federal or state ID. Temporarily, you will need to remove your mask for proper identification. If the document requires witness, the notary cannot be one of them. You will need to bring your own notary witnesses.
